In the current literature, institutional adoption of Corporate Social Responsibility (CSR) governance standards is mainly understood in a binary sense (adoption versus no adoption), and existing research has hitherto focused on inducements as well as on barriers of related organizational change. However, little is known about often invisible internal adoption patterns relating to institutional entrepreneurship in the field of CSR. At the same time, additional information about these processes is relevant in order to systematically assess the outcomes of institutional entrepreneurship (...) and to differentiate between substantive versus symbolic implementation. In this paper, we contribute a comparative intraorganizational differentiation of institutional adoption processes in the field of CSR, and we distinguish between broad and narrow organizational institutional adoption across different management functions relating to institutions of a similar type. Our study is based on a quantitative survey among members of the United Nations Global Compact Network Germany, as well as on qualitative interviews. We analyze different institutional adoption patterns and derive ten theoretical predictors of diverse institutional adoption choices and thereby inform the literatures on institutional entrepreneurship, CSR governance, and Multi-Stakeholder Initiatives. Besides our theoretical contributions, our findings serve as a source of information for practitioners engaged in CSR governance as they provide new insights into the managerial perception and assessment of different CSR standards and initiatives. This chapter highlights the impact of the work of French phenomenologist Michel Henry and Austrian psychoanalyst Otto Rank on psychoanalysis. I contend that Henry and Rank clarify the nature and role of mindfulness and creativity in psychoanalysis. To begin, I draw out the implications of Henry’s critique of Freudian psychoanalysis. In my view, Henry’s work reveals and untangles basic inconsistencies in Freud’s views on the unconscious, affective layer of the subject’s life, and establishes that the creativity of life’s immanent (...) movement is essential to the development of the subject’s personality and to the acquisition and alleviation of neuroses. At the same time, I maintain that, while Henry’s work acknowledges a potential role for mindfulness in the development of life’s creativity, his account is problematic. At the end of the day, Henry’s conception of life as an immanent, self-enclosed reality fails to adequately account for the relation between life (creativity) and intentionality (mindfulness). As a result, it fails to sufficiently account for the intersubjective character of creativity and mindfulness. To address these issues, I bring Henry’s insights into these matters into dialogue with Rank’s psychology of difference, which similarly regards affectivity and creativity as central to human life and to psychoanalysis. By doing so, what comes forward is that mindfulness and creativity are relationships that can strengthen and weaken one another, and which always involve self-enclosure and openness towards others and the cosmos. Bearing this in mind, I maintain that mindfulness and creativity can play an important role in allowing psychoanalysis to realize its aim of improving the well-being of human beings. (shrink)

Bu çalışmamızda dervîşlerin kullandıkları mâddî edevâttan birisi olan tahta kılıç ve ifâde ettiği mânâlara bakacağız ve örnekler üzerinden tahlîl etmeye çalışacağız. Tasavvuf ehli tahta kılıç ile ilgili bir hadîs-i şerîfden yola çıkarak mânevî bir disiplin, (...) ahlakî bir prensip ve nefsânî bir terbiye metodu ortaya koymuşlardır. Yeri geldiğinde cihâd ve mücâhede için zāhir kılıcının yanı sıra bâtın kılıcını kullanmışlardır. ‘Epistemic exploitation occurs when privileged persons compel marginalised knowers to educate them [and others] about the nature of their oppression’ (Berenstain, 2016, p. 569). This paper scrutinizes some of the purported wrongs underpinning this practice, so that educators might be better equipped to understand and avoid or mitigate harms which may result from such interventions. First, building on the work of Berenstain and Davis (2016), we argue that when privileged persons (in this context, educators) repeatedly compel marginalised or oppressed knowers, (...) to not only to educate them, but indeed others, about the nature of their oppression, they risk subjecting them to further epistemic-moral harms. This is due to the likelihood that at least some of their audience will assign them less/more credibility than they deserve based on pre-existing identity-based prejudices. Second, though some of these requests to ‘educate’ or ‘learn more’ masquerade as seemingly virtuous or innocuous epistemic inquiries, privileged persons underestimate or remain ignorant of secondary harms which stem from internalized epistemic obligations, oppressive double-binds (Hirji, 2021), and attendant emotional burdens oppressed knowers carry in relation to the ever-present possibility of ameliorating oppressor mindsets. After surveying each context-specific harm briefly, we then turn to an applied reading of how these exploitative practices sometimes culminate in something we refer to as ‘ontic burnout’, a form of interminable explanatory fatigue brought on by repeated requests to educate the privileged about what it means to be oppressed. Este ensaio teórico tem como objetivo central analisar e debater o pensamento, principalmente na área educacional, do pedagogista e filósofo austríaco Otto Willmann, considerado o fundador da pedagogia social moderna. Trata-se de um estudo de caráter bibliográfico, que faz uso, em primeiro plano, da única obra do autor traduzida para o português e de outras escritas por comentaristas contemporâneos, bem como textos recentes de reflexão, nos quais são analisados o contexto histórico, as influências que ele sofreu, como as teorias (...) de Johann Friedrich Herbart, a sua biografia, as suas obras e não somente a sua contribuição à história do pensamento pedagógico, mas também possíveis contribuições à situação educacional dos dias de hoje. Em um período de grandes mudanças de pensamento no Ocidente, principalmente no mundo germânico do século XIX, um dos aspectos discutidos é como Otto Willmann conseguiu conciliar o aspecto individual com o social na pedagogia, evitando alguns dos extremismos característicos de sua época, como o psicologismo e o determinismo sociais, sendo um pioneiro da pedagogia social. Além disso, busca demonstrar como ele se constituiu um intelectual público, no sentido cunhado por Henry Giroux, contribuindo para transformações em sua realidade, no caso, o Império Austríaco. Entende-se, então, que Willmann se tornou um pensador que buscou a conciliação entre os aspectos individual e social na pedagogia e na didática, justificando, a partir disso, a cientificidade de ambas as áreas, demonstrando a importância do estudo da sociologia e da história da educação como ciências auxiliares da educação. In the Republic, Plato developed an educational program through which he trained young Athenians in desiring truth, without offering them any knowledge-education. This is not because he refused to pass on knowledge but because he considered knowledge of the Good as an ongoing research program. I show this by tracing the steps of the education of the Philosopher-Kings in Plato’s ideal state, to establish that the decades-long educational regime aims at training them in three types of virtue: Moral Virtue; the (...) Cognitive Virtue of Abstraction; the Cognitive Virtue of Debate.Plato’s theory of education has much to teach us about intellectual character education today. The Platonic educational program does not advocate the direct transmission of knowledge from teacher to learner but rather focuses on building the learners’ epistemic dispositions. Building upon the Socratic Method, Plato’s educational program does not ‘spoon-feed’ knowledge to the learners but rather fosters the growth of intellectual virtues through problem-solving.I explain ways in which fostering intellectual virtues through problem-solving could be applied in classrooms today. I conclude that Plato’s rigorous educational program is of definite merit for contemporary virtue education, especially since Aristotle offers us surprisingly little on how to educate for intellectual virtues. The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

Several contemporary virtue scholars trace the origin of the concept of intellectual virtues back to Aristotle. In contrast, my aim in this paper is to highlight the strong indications showing that Plato had already conceived of and had begun developing the concept of intellectual virtues in his discussion of the ideal city-state in the Republic. I argue that the Platonic conception of rational desires satisfies the motivational component of intellectual virtues while his dialectical method satisfies the success component. In addition, (...) I show that Plato considers episteme as the primary intellectual virtue. Episteme, which is quite similar to Pritchard’s The nature and value of knowledge: three investigations, Oxford University Press, Oxford, 2010) conception of understanding, is a cognitive achievement that cannot be attained by luck or testimony. The realization that Plato was the first to conceive of and develop the concept of intellectual excellences is not merely of historic significance. I illustrate, through the example of Zagzebski’s virtue theory, how the Platonic conception of intellectual virtues could prove promising in contemporary debates on virtue epistemology theories. Despite the recent growth of studies in virtue epistemology, the intellectual virtue of epistemic collaborativeness has been overlooked by scholars working in virtue theory. This is a significant gap in the literature given the import of well-motivated and skillful epistemic collaboration for the flourishing of human societies. This paper engages in an in-depth examination of the intellectual virtue of epistemic collaborativeness. It argues that the agent who possesses this acquired character trait is (i) highly motivated to engage in epistemic collaboration (...) (out of her rational desire for intellectual ends), (ii) competent at the characteristic activity of epistemic collaborativeness and (iii) has good judgement as to when and with whom it is epistemically appropriate to engage in epistemic collaboration. Furthermore, this paper discusses the place of epistemic collaborativeness among the virtues and argues that it is an overarching virtue—i.e. it presupposes certain other intellectual virtues although it remains distinguishable from them. Theoretical and practical merits of this virtue are also presented and considered. The virtue of collaborativeness highlights the social dimension of intellectual virtues and could be of significant value for contemporary virtue-based approaches to education. (shrink)

In this paper, I highlight and discuss two significant limitations of Zagzebski’s exemplarist moral theory. Although I focus on Zagzebski’s theory, I argue that these limitations are not unique to her approach but also feature in previous versions of moral exemplarism. The first limitation I identify is inspired by MacIntyre’s understanding of the concept of virtue and stems from the realization that the emotion of admiration, through which agents identify exemplars, should not be examined in vacuo. Scholars working on moral (...) exemplarism have failed to note that admiration is substantially influenced by prevailing socio-cultural norms and values. I show that ‘the admirable’ varies across cultures and time; and the employment of one’s own emotion of admiration in order to derive the meaning of terms such as virtue and duty would only result in a culture-specific understanding of morality. The second limitation, inspired by Butler’s social constructivist understanding of gender, rests on the realization that several features and characteristics of the agent influence their perception of moral excellence. I focus on the issue of gender and highlight that exemplarist theories justify a counter-intuitive gender-specific understanding of morality. (shrink)

ABSTRACT My aim in this paper is to challenge the neo-Aristotelian tradition, currently dominant in contemporary theories of virtue education, by proposing the Platonic pedagogical methodology for virtue cultivation as a worthy alternative to the Aristotelian theory of education. I highlight that, in contrast to Aristotle’s limited remarks concerning virtue education, Plato conceptualizes and develops a rigorous educational theory in the Republic that considers many different facets of education – i.e. moral character education, intellectual character education, exemplarism and educational corruption. (...) Given Plato’s immense contribution to virtue education theory, I conclude that his educational program merits more attention. Our aim in this paper is to argue that Socrates is an intellectual character builder. We show that the Socratic Method, properly understood, is a tool for developing the intellectual character of students. It motivates agents towards the truth and helps them to develop the cognitive skills to gain knowledge of the truth. We further elucidate this proposal by comparing the Socratic Method, so understood, with the widely held contemporary view that the epistemic aim of education is the development of (...) the intellectual virtues. My main aim in this paper is to examine whether gossip should be categorized as an epistemically valuable character trait. Gossip satisfies the necessary and jointly sufficient conditions for an acquired character trait to be classified as an intellectual virtue under the responsibilist understanding of the concept of virtue. The excellent gossiper is motivated to acquire epistemic goods through gossiping, reliably successful in acquiring epistemic goods through gossiping, competent at the activity of gossiping and good at judging when, with whom (...) and what to gossip. Nonetheless, I show that the excellent gossiper inflicts epistemic wrong on others. The excellent gossiper comes to intentionally acquire another person’s private information without their consent. This leaves virtue responsibilists with three options: resist my argument that gossip qualifies as a responsibilist virtue and/or that excellent gossiping inflicts epistemic wrong, bite the bullet and argue that the intellectually virtuous agent sometimes inflicts epistemic wrong on other agents intentionally, develop a no-wrong principle that disqualifies gossip from being categorized as an intellectual virtue. Does the presence of one always imply the presence of the other? Or, is it possible to have one without the other? Here we aim to establish a prima facie case that epistemic wrongs do not always produce epistemic harms. We argue that the epistemic wrongness of an action should never be evaluated solely based on the action's consequences, viz. the epistemic (...) and practical harms suffered by the wronged party. Instead – as we shall show – epistemic harms necessarily follow from epistemic wrongs. To conclude, we suggest ways in which extant accounts of epistemic wrongs and epistemic harms as they cash out in epistemic injustice contexts might be refined in light of our argument. (shrink)

The RSPO and RTRS are global private partnerships that have been set up by business and civil society actors from the North to curb de-forestation and to promote sustainable production of palm oil or soy in the South. This article is about the launch of new national standards in Indonesia and Brazil that are look-alikes of the global standards but have been set up and supported by government or business actors from the South. The two main questions of this article (...) are: do the new national standards in Indonesia and Brazil provide a fundamental challenge to the RSPO and RTRS, or do they demonstrate the successful diffusion and adoption of global private rules into national contexts? Do the new national standards help or undermine the RSPO and RTRS in their efforts to reduce de-forestation? Combining the theoretical notions of proto-institution and rival governance network, a comparative analysis is offered of the launch of the new national standards in Indonesia and Brazil. The conclusion is that, whilst the RSPO and RTRS have served as models for the general design and principles of the national standards, they really differ from the global standards in terms of normative contents: the national standards offer more room to palm oil plantations and large-scale soy producers to expand production at the expense of forests and other high conservation areas. Governments and producer associations in Indonesia and Brazil have not launched national standards to implement the RSPO or RTRS but to challenge these interventions from the North. (shrink)

ABSTRACT This paper scrutinizes the nature and scope of deleterious consequences arising from the pursuit of unattainable pedagogical exemplars on social media. We cash out this phenomenon using exemplarist theory to emphasize the fact that social media (e.g., Facebook, Instagram, TikTok) are platforms in which the vast majority of users present idealized and curated versions of themselves. We focus specifically on educational practitioners and show that attempting to emulate unattainable pedagogical exemplars has negative impacts on agents’ emotional well-being: It can (...) cause burnout and self-conflict, decrease motivation, and also inflict detrimental outcomes on agents’ self-esteem. We conclude that attainable, relevant, relatable, and authentic exemplars are key to a successful exemplarist approach and that safeguarding against unattainable pedagogical exemplars is of paramount importance for the wellbeing of pedagogues, and by extension, the success of educational systems. Building on Jonas and Nakazawa’s recent work (A Platonic Theory of Moral Education), my aim in this paper is to address two widespread misunderstandings of Plato’s ideas about education. The first is that the Platonic theory of education is nonegalitarian, promoting an educational system that justifies and perpetuates a caste-based society. The second is that the Platonic conception of the virtuous agent is primitive and far inferior to the Aristotelian conception, especially concerning the psychological make-up of the virtuous agent.
